DEFINITIONS

For the purposes of these Terms and Conditions:

  • "Customer," "You," and "Your" refer to the individual accessing or using this website and agreeing to SMS Verified's Terms and Conditions.
  • "SMS Verified," "Ourselves," "We," "Our," and "Us" refer to our company, SMS Verified.
  • "Party" or "Parties" refers to both the Customer and SMS Verified.

*All terms relate to the offer, acceptance, and consideration of payment necessary to provide our services to the Customer in a manner that best meets their needs. Words used in the singular, plural, with capital letters, or with pronouns (he/she/they) are considered interchangeable and refer to the same entity.

REGISTRATION

By registering on smsverified.com for the use of the Services in any way, you confirm that you have read and understood the Terms and declare and guarantee that you are a capable natural person over the age of 18. Registration is carried out by providing the Website with Customer data (Login, Password, API keys).

The Customer's Account is protected by appropriate information security safeguards implemented by the Contractor and its service providers in accordance with applicable standards and risk levels.

To create an SMS Verified Account, the Customer must:

  • open the official SMS Verified website at https://smsverified.com and begin the registration process;
  • complete the registration form by providing accurate and complete information;
  • read and accept these Terms and Conditions by clicking "Sign up" or an equivalent confirmation button;
  • confirm the registration via the verification method provided (e.g., email verification, if applicable).

GENERAL TERMS ON THE SERVICE PROVISION

Customers have the right to use our Services only if such use does not contradict the legislation of their country. If the Customer plans to use the Services in a territory where such use is prohibited by law, the Customer must not use the Services. We reserve the right to restrict access to the Services for users in jurisdictions subject to international sanctions or where provision of the Services is unlawful.

Geographic Restrictions: We regret to inform potential users that our services are not available for residents of the United States and Russia. By agreeing to these terms and conditions, users acknowledge that they are not citizens or permanent residents of the United States or Russia and that they will not attempt to access our services from within the United States or Russia. Any attempt to register or use our services from the United States or Russia will be considered a breach of our terms and may result in the termination of the user's account without prior notice. We reserve the right to verify the location of our users and to take necessary actions to enforce this policy. We appreciate your understanding and cooperation in this matter.

The Customer's right to receive services from SMS Verified is conditioned upon:

SMS Verified's obligation to provide services is directly dependent on the Customer's fulfillment of these requirements. In the event of non-payment or violation of these Terms and Conditions and other policies available on the Website, SMS Verified reserves the right to suspend or refuse service in full or in part, in accordance with these Terms and Conditions, and applicable civil legislation.

Services are provided subject to availability, which may depend, among other factors, on the Customer's adherence to these Terms and Conditions and other policies available on the Website. Failure to comply with these documents may result in SMS Verified being unable to fulfill its service obligations.

Given the nature of SMS Verified's services - which are designed to meet individual user requests - the Company is under no obligation to provide services to every applicant and may, at its discretion, refuse service. For example, service may be denied if the requested activity violates the Terms and Conditions and other policies available on the Website, service categories, or intended use.

The terms, scope, and nature of services are defined in accordance with these Terms and Conditions and the Website Rules.

All services provided through the Website may be modified, supplemented, or updated. Accordingly, services are offered on an "as is" basis - in the form and volume available at the moment of the Customer's request.

SMS Verified reserves the right to send you notifications, including updates on service terms and other important messages, via the contact email specified in your account profile.

The Customer agrees to comply with all applicable laws, these Terms and Conditions, and other policies available on the Website while using SMS Verified's services.

All actions performed using your Login, Password, API key are considered to be performed by you personally and hold the same legal effect as a simple electronic signature.

Digital Signature and Account Security: Username, Password, API key, and Sign in with Google are considered to be Customer's simple digital signature. The Customer uses Username, Password, API key, and Sign in with Google in the Personal Account on the Website. The Customer is personally responsible for the safety and proper use of the Username, Password, API key, and Sign in with Google.

Lawful use and prohibition of fraud

You must not use the Service, or any numbers provided through it, for any fraudulent, unlawful, deceptive or abusive activity. If we identify evidence of fraudulent or unlawful use, we may suspend or permanently block your account and any associated access without notice.

No mass registration for abusive purposes

You must not use the Service to create, assist in creating, or operate multiple accounts on third-party platforms for fraudulent, deceptive, automated, or otherwise prohibited purposes.

Purpose of the Service

Our numbering solutions are provided to offer users an alternative to exposing their personal numbers online and to help protect sensitive data when interacting with third-party services. Use is limited to legitimate purposes and in accordance with applicable laws and the relevant third-party platform rules.

Outbound communications not permitted

The Service does not provide technical capabilities for outbound communications. Our system is designed exclusively for receiving inbound communications (SMS and voice calls) and does not support placing voice calls or sending SMS/MMS or other outbound messages using numbers provided by the Service.

Technical Limitation: Our service infrastructure does not include outbound communication capabilities - numbers provided are configured for inbound communications reception only.

For Authorities: We confirm that our service does not send any outbound communications, messages, or calls. All numbers provided are configured for inbound communications reception only, with no technical capability for outbound communications.

Enforcement and account actions

We reserve the right to monitor for abuse, apply rate limits, block traffic, suspend or terminate access, and reclaim numbers where we reasonably suspect a breach of these terms or to protect our network, users, or third parties. Refunds will not be due where action is taken for breach.

Usage Monitoring and Abuse Detection

We implement comprehensive monitoring systems to ensure compliance and prevent abuse:

Cooperation with law enforcement

We may retain and disclose purchaser and account details, relevant logs, and other necessary information to law enforcement or competent authorities upon receipt of a lawful request (for example, a court order, warrant, or other legally valid process), or where disclosure is otherwise permitted to protect life or prevent serious harm. Any such processing will be carried out in accordance with our Privacy Policy and applicable data-protection laws.

Compliance with third-party terms

You are responsible for ensuring your use of the Service complies with the terms, policies, and acceptable-use rules of any third-party service or platform you interact with.

No emergency use

The Service is not intended for, and does not support, emergency calling or communications.

Telecom Regulatory Compliance

Our services are provided in compliance with applicable telecom regulations and carrier requirements:

Number Management:

  • All numbers provided are obtained through legitimate channels from authorized carriers
  • Numbers are used in accordance with carrier agreements and telecom regulations
  • We maintain proper records of number allocation and usage as required by law

Carrier Compliance:

  • We work exclusively with licensed telecom carriers and operators
  • All carrier relationships are governed by formal agreements that include compliance requirements
  • We monitor and ensure ongoing compliance with carrier terms and conditions

International Compliance:

  • Services are provided in compliance with international telecom regulations
  • We respect international sanctions and trade restrictions
  • Cross-border services are provided in accordance with applicable international law

Emergency Services:

  • Our numbers are not connected to emergency services (911, 999, 112, etc.)
  • Users must not rely on our numbers for emergency communications
  • We are not responsible for emergency service connectivity or response

Number Portability:

  • Numbers provided are temporary and cannot be ported to other carriers
  • Users cannot transfer our numbers to their personal accounts
  • Numbers remain the property of the originating carrier

Regulatory Reporting:

  • We maintain records required by telecom regulators
  • We cooperate with regulatory investigations and audits
  • We report usage data as required by applicable regulations

INFORMATION SERVICES

SMS Verified provides Customers with the opportunity to place Orders for temporary (disposable) phone number services to receive SMS messages. The Customer pays SMS Verified a fee for one or more of the following services:

  • SMS Receipt Service
    • providing the technical capability to view SMS messages received at the selected temporary number via the Customer's Personal Account;
  • API Access Service
    • providing access to the API for automated ordering and retrieval of results.

An Order is considered placed when the Customer performs the following actions:

  • Logs into the Website through an authorized account;
  • Selects service parameters (such as country, platform) and clicks the "Buy now for…" button on the Website, or submits the same criteria via an API request;
  • Receives from SMS Verified the selected temporary (disposable) number and corresponding SMS messages, which are then displayed in the Customer's Personal Account and/or via API response.

The Order is deemed accepted by SMS Verified upon the actual provision of the services specified in the Order.
The Order is deemed completed when all actions required for the service have been performed.

Order Cancellation and Refunds

The Customer may, at their discretion, cancel an Order or experience non-implementation of an Order under the following terms:

  • In case of Order Cancellation, the payment for the canceled Order is automatically refunded in full to the Customer's Account Balance within 15 minutes after clicking the "Cancel" button.
  • In case of Non-implementation, the payment for the unfulfilled Order is refunded in full to the Customer's Account Balance within 15 minutes.
  • If the Customer has used the provided number and received SMS for an implemented Order, no refund is available for that Order.
  • The payment is refunded if you cancel the order or, in some cases, if SMS does not arrive within approximately 5 minutes.

Abuse Prevention and Restrictions:

  • In case of abusing the refund policy, restrictions will be imposed on your account
  • The website has a rating system; in case of mass abuse of the right not to receive SMS to a dedicated phone number within the specified time, restrictions will be imposed on your account for 1 (one) hour
  • We are not responsible for incorrect use of API functions or for other software bugs that the user makes upon using the API functions incorrectly; refund for software bugs made by users is not stipulated
  • We are not responsible for the ban of registered accounts, since ban is affected by many factors; if you are not satisfied with the number, click on the "Cancel" button; refund for banned accounts is not stipulated

Service Limitations

SMS Verified does not guarantee:

  • The successful delivery or content of any SMS message;
  • The timeliness of message delivery;
  • The continued availability of any specific number.

These aspects depend on mobile network operators and third-party providers. SMS Verified acts solely as an intermediary between the Customer and the telecom operator.

Specific Service Restrictions:

  • You can use the received phone number only to receive SMS from the selected service; all other SMS from other services will be discarded
  • The quantity of received SMS within the allotted time (5-30 minutes) is unlimited
  • We maintain a list of prohibited senders and keywords - SMS from blocked senders or containing prohibited keywords will not be delivered
  • It is prohibited to use the services for the implementation of paid subscriptions
  • Transferring the balance from account to account is prohibited

Operators and Partnerships

Operators provide SMS Verified with phone numbers for subsequent use by Customers.
To cooperate with SMS Verified, an Operator must contact the Company via email or technical support channel specified on the Website and provide accurate and complete information about their service and phone numbers.

Operators guarantee that:

  • All provided numbers have been obtained legally;
  • Their use and transfer do not violate any third-party rights;
  • The numbers have not been used for illegal activities, including but not limited to fraud, money laundering, spam, or other unlawful actions;
  • The Operator holds all necessary licenses and permits to supply numbers to SMS Verified.

Operators further agree to indemnify SMS Verified against all losses, claims, damages, fines, or expenses (including legal fees) resulting from any breach of these guarantees or other obligations, including those made by third parties or government authorities.

SCOPE OF THE SERVICES

The scope of services provided by SMS Verified is determined by the number of Orders successfully completed by the Customer.

COST OF THE SERVICES AND PAYMENT PROCEDURE

The cost of the Contractor's services is displayed on the Website in U.S. dollars (USD).

The Company is not a tax agent and therefore shall not provide the Customer's financial information to any third parties.

The cost of each service provided by the Contractor is determined based on the parameters selected by the Customer (such as country, service type, or operator).

Payment for the Contractor's services is made by adding funds to the Customer's account balance in the Personal Account. At the moment of replenishment, the Contractor's services are considered prepaid for the amount of the deposit. The Customer then uses the services as the balance is spent according to the prices applicable at the time of each order.

Payment Processing: Payment for any service is debited immediately upon purchase of a phone number. The fee of payment systems upon depositing funds to an electronic balance is indicated in the "Top up balance" section or when going to the payment system page.

The Contractor reserves the right to provide discounts for specific orders in accordance with its marketing policies.

Replenishment of the account balance may be carried out in different currencies. In this case, the payment is converted and credited to the Customer's balance in U.S. dollars (USD) according to the exchange rate at the moment of transaction processing.

Each Party shall independently pay any bank fees or other charges related to the transfer or receipt of payments as imposed by their respective banks. Fees charged by intermediary banks for cross-border transactions shall be borne by the Customer.

The Customer is obliged to inform the Contractor in writing about any obligations arising in the Customer's country of residence that require the Contractor to withhold, transfer, or otherwise pay taxes, duties, or other similar charges ("Taxes") related to the amounts payable to the Contractor.

All remuneration amounts are exclusive of such Taxes. If it becomes necessary to withhold or pay any Taxes in the Customer's country of residence, the Contractor's remuneration shall be increased by the amount of such Taxes.

The Parties agree to cooperate and exchange the necessary information or documentation required to apply any international agreements, conventions, or other arrangements that may reduce or eliminate such withholdings or deductions.

REPORT ON THE PROVIDED SERVICES

The Contractor provides the Customer with full information about all Orders - including successful, canceled, or failed activations - in the Activations History section of the Customer's Personal Account. All services are considered provided in accordance with Section 4.

The Customer is responsible for reviewing the information in the Activations History regarding all Orders for each reporting period.

If the Contractor does not receive a written and reasoned objection from the Customer within five (5) calendar days following the end of the reporting period, the services listed in the Activations History shall be considered properly rendered and fully accepted by the Customer without any claims.

If the Customer disagrees with the information in the report, they must submit a written and reasoned objection within the specified five (5) calendar days by contacting the Contractor via email or Telegram (contact details are available on the Website).

The Contractor reviews such objections within fifteen (15) business days from the date of receipt. After consideration, both Parties may coordinate and clarify the report for the given reporting period through email correspondence until an agreement is reached.

Both Parties unconditionally agree that all data on the provided services is based on the information recorded on the Contractor's Website.

RIGHTS AND OBLIGATIONS OF THE PARTIES

The Contractor (Administrator) has the right to:

  • independently determine and amend the operational rules, structure, and content of the Website;
  • make amendments to any internal policies or documents published on the Website;
  • perform technical maintenance, updates, and configuration of the Website;
  • unilaterally suspend or terminate the Terms and Conditions in the following cases:
    • if reliable information is received about the Customer's fraudulent or illegal activity related to the Website or the provided services;
    • if the Customer provides false, incomplete, or misleading information related to their obligations under this Agreement;
  • communicate with Customers regarding the use of the Website, including via email or Telegram;
  • receive payment for the services in accordance with Section 6;
  • suspend, restrict, or terminate the Customer's access to all or part of the Website, including the Personal Account, in case of violation of these Terms and Conditions, receipt of relevant complaints from third parties, or if the Contractor determines that the Customer's activity poses a threat to the Website, other Customers, or the Contractor's reputation. Such suspension may be implemented with or without prior notice, and the Contractor shall not be liable for any damages resulting from such actions;
  • delete or block a Customer's account in accordance with these Terms and Conditions;
  • add the Customer's registered email address to the Website's mailing list for service-related notifications or updates.

The Contractor (Administrator) is obliged to:

  • ensure the technical functionality of the Website and access to the Customer's Personal Account;
  • provide the services in accordance with these Terms and Conditions;
  • not be responsible for software errors, malfunction, or incorrect use of the API by the Customer or any third parties involved by the Customer;
  • make reasonable efforts to maintain continuous access to the Website, but does not guarantee uninterrupted access due to technical maintenance, updates, or issues outside its control.

The Customer has the right to:

  • receive services from the Contractor in accordance with these Terms and Conditions;
  • contact the Contractor for support or inquiries via email or Telegram.

The Customer is obliged to:

  • comply with these Terms and Conditions;
  • pay for the services of the Contractor in the manner and under the conditions specified in Section 6;
  • not use the Contractor's services for illegal purposes, spam, fraud, or actions that may harm the Contractor or third parties;
  • reimburse the Contractor for any losses, including fines or claims from regulatory authorities, caused by the Customer's violation of these Terms and Conditions, provided that the Contractor supplies documents confirming such losses.

PROHIBITED USES

The Customer may use the Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations in any jurisdiction. The Customer is solely responsible for their actions and the content they interact with through the Service.

The Customer agrees not to use SMS Verified Services:

  • To commit, assist, or promote any unlawful or fraudulent activity, or to encourage others to engage in such acts, including but not limited to money laundering, terrorism, child exploitation, narcotics or human trafficking, or evasion of international sanctions;
  • To harm or attempt to harm minors in any way, including by exposing them to inappropriate or illegal content;
  • To send or facilitate the sending of "junk mail," "chain letters," "spam," or any other unsolicited communications;
  • To impersonate any person, company, or entity, or misrepresent your affiliation with any individual or organization;
  • In any manner that infringes upon the rights of others, or that is illegal, fraudulent, harmful, defamatory, or otherwise objectionable;
  • To engage in any activity that restricts or interferes with others' use or enjoyment of the Service, or which, as determined by SMS Verified, may harm the Company, other users, or expose them to liability;
  • In any way that violates any applicable national or international laws or regulations;
  • For banking, financial services, payment applications, cryptocurrency exchanges, or any financial platform verification purposes
    • we do not permit the use of our numbers for potentially fraudulent financial activities;
  • For any purpose that could facilitate identity theft, account takeover, or unauthorized access to financial accounts or services;
  • For verification with platforms where the use of temporary numbers violates their terms of service or could constitute fraud or deception.

The Customer further agrees not to:

  • Use the Service in any way that could damage, disable, or impair its operation or performance;
  • Use any automated system, bot, or manual process to monitor, copy, or extract data from the Service without prior written permission from SMS Verified;
  • Introduce or distribute any viruses, malware, Trojan horses, worms, or other malicious or harmful software;
  • Attempt to gain unauthorized access to, interfere with, or disrupt the Service, its servers, or connected databases;
  • Perform or attempt to perform any denial-of-service or distributed denial-of-service attack;
  • Use the Service for purposes that violate the rights of SMS Verified, mobile operators, or third parties.

SMS Verified reserves the right to suspend or terminate any Customer account, access, or service at any time, with or without prior notice, if the Customer violates any of the above provisions.

Specific Enforcement for Financial Fraud Prevention: We actively monitor for and block accounts that attempt to use our numbers for banking, financial services, payment applications, cryptocurrency exchanges, or any financial platform verification. Any detected use of our service for potentially fraudulent financial purposes will result in immediate account suspension or termination without notice or refund.

SMS Verified reserves the right to deny service or restrict access to Customers located in countries or territories listed in any applicable international sanctions lists.

SMS Verified will cooperate fully with law enforcement authorities in investigations of any suspected unlawful or prohibited use of the Service. Violations of law or network security may result in civil or criminal liability.

CONFIDENTIALITY

Both Parties agree not to disclose any information regarding these Terms or any other information obtained during the performance of their obligations, except where disclosure is required by applicable law.

Disclosure of confidential information is not considered a breach if it is made in response to a lawful request from law enforcement agencies, government authorities, or other authorized officials, in accordance with the applicable legislation.

Collection, storage, and processing of the Customer's personal data are carried out in accordance with the Privacy Policy of the Website.

Data Retention and Deletion Policy

We maintain specific data retention periods for different types of information:

Customer Account Data:

  • Account information and profile data: Retained for the duration of the account plus 7 years after account closure
  • KYC documents and verification data: Retained for 7 years after account closure or last transaction
  • Login credentials and authentication data: Retained for the duration of the account plus 2 years after account closure

Usage and Transaction Data:

  • SMS content and metadata: Retained for 90 days after message receipt
  • Transaction logs and payment records: Retained for 7 years after the transaction
  • API usage logs and access records: Retained for 2 years after the activity
  • Audit trails and compliance logs: Retained for 7 years after the activity

Communication Records:

  • Customer support communications: Retained for 3 years after the last communication
  • Legal and compliance communications: Retained for 7 years after the communication

Data Deletion: Upon account closure or upon request (subject to legal requirements), we will delete personal data according to the retention periods specified above. Some data may be retained longer if required by law, regulatory requirements, or legitimate business purposes.

LIMITATION OF LIABILITY

SMS Verified is not responsible for monitoring or controlling how Customers use the provided services. Each Customer is solely responsible for ensuring that their use of the Website and Services complies with applicable laws and regulations.

SMS Verified does not guarantee the delivery, timing, or content of SMS messages, nor the continuous availability of phone numbers. These factors depend on third-party mobile operators and external systems beyond the control of SMS Verified. The Company acts solely as a technical intermediary providing Customers access to available numbers.

Except as prohibited by applicable law, the Customer agrees to hold SMS Verified, its owners, officers, directors, employees, and agents harmless from and against any indirect, punitive, special, incidental, or consequential damages, regardless of how they arise (including attorney's fees, legal expenses, or arbitration costs). This includes, but is not limited to, damages resulting from contract, negligence, tort, or any other cause of action connected with or arising from these Terms and Conditions, the use of the Website, or the Services provided.

SMS Verified shall not be liable for any loss, damage, or injury resulting from force majeure events, failures of third-party systems (including operators), or actions of Customers that violate these Terms and Conditions.

Force Majeure Events

Force majeure events include, but are not limited to:

  • Natural disasters (earthquakes, floods, hurricanes, etc.)
  • Acts of war, terrorism, or civil unrest
  • Government actions, regulations, or sanctions
  • Labor strikes, lockouts, or other labor disputes
  • Cyber attacks, system failures, or internet outages
  • Carriers' network failures or service interruptions
  • Power outages or infrastructure failures
  • Pandemics, epidemics, or public health emergencies
  • Changes in applicable law or regulations
  • Actions by regulatory authorities or government agencies

During force majeure events, SMS Verified's obligations under these Terms and Conditions shall be suspended to the extent necessary due to such events. We will make reasonable efforts to resume normal operations as soon as practicable.

Except as prohibited by law, any liability of SMS Verified shall be limited to the total amount paid by the Customer for the Service related to the specific claim. Under no circumstances shall SMS Verified be liable for any consequential, punitive, or indirect damages. Certain jurisdictions do not allow the exclusion or limitation of such damages, so these limitations may not apply to some Customers.

TERMINATION

If the Customer no longer wishes to use our Services, they may stop making payments for future periods or remove all access to the Service, including deleting any connected accounts.

The Customer may also contact Customer Support to request account deletion. Deleting the account constitutes withdrawal of the Customer's consent for the processing of personal data. Following such a request, SMS Verified will delete all personal records, except those required to be retained by law, public interest, or legitimate business purposes.

SMS Verified may terminate or suspend a Customer Account and block access to the Service immediately, without prior notice or liability, at its sole discretion, for any reason, including but not limited to a breach of these Terms.

All provisions of these Terms that by their nature should survive termination shall continue to apply after termination. This includes, without limitation, ownership rights, warranty disclaimers, indemnification obligations, and limitations of liability.

MISCELLANEOUS

The Contractor reserves the right to amend or supplement these Terms and Conditions to the extent permitted by applicable law, and to publish new versions on the Website at any time. The effective date of any amendment is the date the new version is posted on the Website. Customers are responsible for reviewing the current version of the Terms and Conditions.

Continuing to use the services after the entry into force of amendments constitutes acceptance of the updated Terms and Conditions. Such amendments do not apply to services that were ordered and fully paid for before the amendments took effect.

The Contractor may refuse to provide services in cases allowed by law, including if the Customer violates applicable legislation, these Terms, or Website policies. The Contractor will notify the Customer via the email address provided in their account.

The Contractor may also terminate services at the Customer's initiative. If a Customer does not log in to their account for a period of one (1) year, the account may be considered inactive and terminated on the Customer's initiative after the expiration of this period.

Account Deletion Policy: Your account will be deleted if you do not use it for more than 1 year; the balance is not restored upon account deletion.

These Terms and Conditions constitute the entire agreement between the Parties regarding the subject matter and supersede any previous agreements, understandings, or communications, unless otherwise expressly agreed in writing by the Parties.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

Dispute Resolution

Before initiating any legal proceedings, the Parties agree to attempt to resolve any dispute through good faith negotiations. If such negotiations fail, either Party may refer the dispute to mediation. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in Dubai, United Arab Emirates, in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
